Terms & Conditions

Regulation on the Provision of Electronic Services within the Website https://www.theinterviewplan.com/ . This Regulation is issued in accordance with Article 8, Section 1, Paragraph 1 of the Law of July 18, 2002, on the provision of electronic services (consolidated text: Legislative Herald 2013, Article 1422) and is provided to Users free of charge.

GENERAL INFORMATION

1. These rules (hereinafter "Rules") define the rules for using the website available at https://www.theinterviewplan.com/ (here in after "Website").

2. By using the website https://www.theinterviewplan.com/, you accept the regulatory rules, the current version of which can be found at: https://www.theinterviewplan.com/terms-and-coniditions, as well as the privacy policy, which is an integral part of these rules on the website. 3. The owner of the website https://www.theinterviewplan.com/privacy-policy is: SP Vitaly Botvich 

4. A User within the meaning of the Rules is any person visiting or using the services of the Website through a web browser or through the Service Provider's Mobile applications.

5. The provision of offers to the User by the Service Provider through the Website is free of charge. In particular, no fee is charged for viewing the Service Provider's offers. The expenses incurred by the User are related to the purchase of Services and the right to use them for personal purposes. These expenses do not depend on how many devices the User uses the Platform, and the User incurs them only once for each purchased Service.

6. The subject of the Service Provider's activity is to provide the User with offers and the opportunity to purchase and implement the educational process (hereinafter referred to as the Service) of ordered education and/or tests/exams, trial interviews on the Website https://www.theinterviewplan.com/ .

7. According to the Regulation, the Service means: a) the learning process is carried out online in a personalized mode for each user, allowing them to start learning at any time and organize their time flexibly according to your needs and possibilities; b) training in the form of electronic video materials, containing lectures, photographs, electronic documents, exercises, and tests, which are works within the meaning of the Law of February 4, 1994, on copyright and related rights (consolidated text: Legislative Herald 2006) No. 90, item 631 as amended), the license for which is issued by the Service Provider; And in the form of online lectures, tests, and trial interviews. c) Certificate of completion of the course, available after successful completion of the training and compliance with formal requirements for completion of the training, in English as an electronic attachment (PDF document), in case of passing test interviews, the user receives feedback in the form of an electronic document (PDF document) with results and recommendations; d) certification exam in the form of tests, checking knowledge in the form of closed and/or open questions on a wide range of topics in this field, online tests and interviews, the condition for passing which is obtaining at least 80% positive answers, ending with the receipt of a Specialist Certificate.

8. The condition for using the Website https://www.theinterviewplan.com/ is that the User must select a course or type of interview, convenient time, and accept the Rules. The User's acceptance of the provisions of the Rules is equivalent to the User's statement that he has read these Rules, understood their contents, and fully accepts their provisions.

9. The Consumer within the meaning of the provisions of the Civil Code is a natural person performing a legal act and concluding a contract not directly related to his business or professional activity.

TECHICAL REQUIREMENTS

1.  To work with the website https://www.theinterviewplan.com/ , a computer connected to the Internet is required. The website can also be used with compatible tablets and smartphones.

2. The Service Provider is not responsible for difficulties in using the service arising from incorrect configuration of the User's software or hardware, as well as from problems with the User's equipment or connection to the Internet.

CONTRACT CONCLUSION AND IMPLEMENTATIO

1. To work with the website https://www.theinterviewplan.com/ , a computer connected to the Internet is required. The website can also be used with compatible tablets and smartphones.

2. The Service Provider is not responsible for difficulties in using the service arising from incorrect configuration of the User's software or hardware, as well as from problems with the User's equipment or connection to the Internet.

3. The fee for the services is specified on the Website https://www.theinterviewplan.com/ . The prices listed on the website include VAT at a rate of 23%, based on the generally applicable provisions of Polish law.

4. The following payment methods are available: a) fast online payment through cooperating online payment providers.

5. In the case of fast online payment, payment can be made immediately after placing the order by one of the methods. In this case, the payment is usually processed within a few minutes after its initiation.

6. In the case of a bank transfer, payment is considered made after the transfer is received into the Service Provider's bank account. To correctly identify the payment, the transfer name must include the order number to which the payment relates.

7. In the case of Twisto payments, the User will receive a notification to their email address provided when selecting the service, immediately after a positive check by the Twisto system, and can make the payment within 21 days without any additional costs.

8. Information about all available payment methods is available at https://www.theinterviewplan.com/.

9. Detailed rules for using payment methods provided by external providers are specified in the relevant provisions provided by these providers. The use of these payment methods implies acceptance of the provisions of the above regulations. The Service Provider is not responsible for the payment process carried out by external providers.

10. Making a payment is equivalent to concluding a contract between the User and the Service Provider in electronic form for the provision of the selected Service(s) in accordance with the description of the Service on the Website https://www.theinterviewplan.com/  and the provisions of the Regulation.

11. If payment is not made by the User or the User is exempt from participation fees, the Agreement is concluded in electronic form when the User reserves the date and time of participation.

12. The contract can be concluded in another way if such an option is provided by the Service Provider or by agreement of the parties.

13. Full access and confirmation to the purchased Services within the Website https://www.theinterviewplan.com/ are activated after payment (conclusion of the Agreement).

14. Providing the purchased Service available online via the link that will be sent to the email address 10 minutes before the start of the meeting is equivalent to the actual provision of the Service. 

15. If the purchaser is different from the User, or is a company or institution, please provide the purchaser's relevant data for issuing an invoice with VAT in the invoice data section of the order form.

USER RIGHTS AND LICENSE

1. The User has the right to: a) access to materials provided to him as part of participation in training and/or trial interviews, purchased on the Website https://www.theinterviewplan.com/  individually, at his own expense; b) access to educational materials provided by the program, in electronic form, and participation in the educational process; c) receive a certificate of completion after successfully completing the training and meeting the formal conditions specified in the Regulation (if training was completed), a document with recommendations and results of the trial interview (if the trial interview was conducted); d) participate in special promotions and contests intended for Website https://www.theinterviewplan.com/  Users;

2. The User is obliged to: a) complete all stages of training independently; b) complete the trial interview at the time and date selected by him; c) comply with other provisions of the regulations.

3. The User acknowledges that all materials provided to him as part of participation in training or during the trial interview through the Website https://www.theinterviewplan.com/ , constitute the exclusive intellectual property of the Service Provider or other relevant persons and are subject to legal protection in accordance with applicable rules (including the Law of February 4, 1994, on copyright and related rights).

4. The User undertakes to use the materials entrusted to him and the content contained therein (including, in particular, training materials available within the website and electronic learning) only for his own educational purposes and not to provide them to third parties without the consent of the Service Provider or the relevant copyright owner.

5. The User who has paid for training/trial interview may print, download, and save additional training materials sent to him only for personal use without the right to further distribution.

6. The User is not entitled to download and save video tutorials.

7. If you wish to use materials for which the Service Provider has copyright beyond the Website https://www.theinterviewplan.com/, you must obtain written consent from the Service Provider.

8. The Service Provider reserves the right to periodically update the content of the offered training, including changing the content of lessons, tests, exercises, and educational materials provided as part of the continuous improvement service offering.

9. In case of violation of the provisions of this section of the Regulation, the Service Provider and rights holders may demand compensation from the User for any material and non-material damages incurred as a result of such violation. § 5 Provider's Rights and Responsibilities

    a. The service provider is obligated to reliably provide the User with the Service described in the general provisions of the Regulation.

    b. The service provider reserves the right to temporarily block access to the Website for maintenance work.

    c. The service provider reserves the right to temporarily block access to selected Services if it is determined that the user's data security is at risk - for example, in cases of suspected hacking.

     d. The service provider is not responsible for non-performance or improper provision of Services if it is caused by circumstances beyond the control of the service provider, for which the service provider is not responsible, particularly as a result of actions or inactions of telecommunications operators, providers of communication lines, or electricity.

     e. The service provider is not responsible for the content posted, stored, or transmitted on the Website as part of the user's use of the Services.

COMPLAINTS

а. A complaint submitted by the Website User regarding non-performance or improper performance of services must include: a) name, surname, and contact details of the complainant, b) email address of the User filing the complaint, c) the subject of the complaint considering the circumstances justifying the claim, d) signature of the complainant and date.

b. The complaint should be sent by email to the address for correspondence of the service provider, specified on the website https://www.theinterviewplan.com/ .

c. The response will be provided in the form in which the service provider received the notification, to the address indicated in the notification.

d. The complaint will be considered within 14 days from the date of receipt of the written notification, unless otherwise provided by applicable law.

e. In situations where additional explanations are needed from the User to consider the message, the response time to the message is additionally extended for the time of providing explanations by the User.

RIGHT OF WITHDRAWAL FROM THE CONTRACT

a. A complaint submitted by the Website User regarding non-performance or improper performance of services must include: a) name, surname, and contact details of the complainant, b) email address of the User filing the complaint, c) the subject of the complaint considering the circumstances justifying the claim, d) signature of the complainant and date.

b. The complaint should be sent by email to the address for correspondence of the service provider, specified on the website https://www.theinterviewplan.com/ .

c. The response will be provided in the form in which the service provider received the notification, to the address indicated in the notification.

d.  The complaint will be considered within 14 days from the date of receipt of the written notification, unless otherwise provided by applicable law.

e. In situations where additional explanations are needed from the User to consider the message, the response time to the message is additionally extended for the time of providing explanations by the User.

PRIVACY POLICY AND PERSONAL DATA PROTECTION

a. A complaint submitted by the Website User regarding non-performance or improper performance of services must include: a) name, surname, and contact details of the complainant, b) email address of the User filing the complaint, c) the subject of the complaint considering the circumstances justifying the claim, d) signature of the complainant and date.

c. The response will be provided in the form in which the service provider received the notification, to the address indicated in the notification.

CHANGES TO OFFERS AND PROMOTIONS

a. A complaint submitted by the Website User regarding non-performance or improper performance of services must include: a) name, surname, and contact details of the complainant, b) email address of the User filing the complaint, c) the subject of the complaint considering the circumstances justifying the claim, d) signature of the complainant and date.

b. The complaint should be sent by email to the address for correspondence of the service provider, specified on the website https://www.theinterviewplan.com/ .

c. The response will be provided in the form in which the service provider received the notification, to the address indicated in the notification.

d. The complaint will be considered within 14 days from the date of receipt of the written notification, unless otherwise provided by applicable law.

e. In situations where additional explanations are needed from the User to consider the message, the response time to the message is additionally extended for the time of providing explanations by the User.

FINAL PROVISIONS

a. The service provider is not responsible for any difficulties in providing the Service caused by random factors beyond the control of the service provider (including factors dependent on the User, third parties, or force majeure circumstances).

b. The contract is considered concluded from the moment the User receives a certificate of completion of the training, after the expiry of the 12-month period intended for the provision of the Service, in the modes specified in the Regulations or by mutual agreement.

c. None of the provisions of these Rules are intended to violate the rights of the User and the Consumer and cannot be interpreted as such, as in case of inconsistency of any part of the Rules with applicable law, the service provider declares that absolute compliance and application of this Law instead of the disputed provision of the Regulations.

d. The service provider reserves the right to change these Rules at any time and at its discretion. In case of significant changes, users will be notified through notifications on the service provider's website.

e. The current version of the Regulations is always available at the address https://www.theinterviewplan.com/terms-and-coniditions

f. In matters not regulated by these Rules, relevant applicable legal norms apply. Disputes, if the buyer expresses such a desire, are resolved through mediation in the Governorate Trade Inspection or in an arbitration court at the Governorate Trade Inspection or equivalent and lawful methods of pre-trial or out-of-court settlement of disputes in court. Ultimately, the matter is decided by a court of local and substantive jurisdiction.

g. The provision comes into force upon publication.
